These Terms and Conditions (“Terms”) govern your use of our website and application located at https://www.similia.io/ and the services we provide. By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

All repertories, materia medica content, and other materials provided through the Service, even if based on content in the public domain, are protected by copyright as unique compilations, adaptations, or reformattings created by SIMILIA LTD.

Your License to Us: By submitting, posting, or displaying User Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content solely for the purpose of providing and improving the Service.

Prohibited Uses: You may not copy, modify, distribute, sell, or lease any part of our Service or included Content, nor may you reverse engineer or attempt to extract the source code of our Service, unless you have our written permission or applicable laws prohibit these restrictions.

By submitting, posting, or displaying User Content (such as cases and repertorizations) on or through the Service, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service.

You represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

10. Indemnification

You agree to defend, indemnify, and hold harmless SIMILIA LTD, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Service.

11. International Data Transfers

Your personal data may be processed outside of your jurisdiction due to our use of cloud services such as Firebase and Vercel. These providers may store or process your data in the European Union, United States, or other regions where they maintain facilities.

When transferring data internationally, we ensure appropriate safeguards are in place, such as standard contractual clauses approved by the European Commission, adequacy decisions, or other legally valid mechanisms to protect your data in compliance with GDPR requirements.

We will retain your personal information only for as long as is necessary for the purposes set out in our Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our policies.

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our application is not intended for use by children under the age of 16. We do not knowingly collect personally identifiable information from children under 16. If you are a parent or guardian and believe your child has provided us with personal information, please contact us.

19. Data Protection Authority

If you are located in the European Economic Area and believe we are unlawfully processing your personal information, you have the right to complain to your local data protection supervisory authority.
